1. Agreement to Terms
By accessing or using Barberium ("Service," "Platform"), operated by Vladyslav Trusiuk ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of the Service immediately.
2. Description of Service
Barberium is a cloud-based barbershop and salon management platform that provides appointment scheduling, client management, staff management, online booking, business analytics, and related features to barbershop and salon owners ("Users").
3. Account Registration
To access the Service, you must register an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use at vladislavtrusiuk25@gmail.com.
4. Free Trial
New accounts receive a 30-day free trial with access to all features. No payment information is required to start a trial. At the end of the trial period, continued access requires an active paid subscription.
5. Subscription and Billing
The Service is offered on a subscription basis, billed monthly. Subscriptions automatically renew each month until cancelled. Payments are processed by Paddle.com, which acts as the Merchant of Record for all transactions. By subscribing, you also agree to Paddle's Terms of Service. All prices are displayed in USD and are exclusive of any applicable taxes unless otherwise stated.
6. Cancellation and Refunds
You may cancel your subscription at any time from the Billing section of your account. Upon cancellation, you retain access to paid features until the end of the current billing period. Refunds are governed by our Refund Policy and Paddle's refund policy as Merchant of Record.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose
- Attempt to gain unauthorized access to any part of the Service
- Upload malicious code, viruses, or harmful content
- Resell, sublicense, or commercially exploit the Service without prior written consent
- Use the Service to send unsolicited communications
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
9. Intellectual Property
All content, features, source code, and functionality of Barberium are the exclusive property of Vladyslav Trusiuk and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Vladyslav Trusiuk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the three months preceding the claim.
12. Complaints
If you have a complaint about the Service or billing, please contact us at vladislavtrusiuk25@gmail.com. We aim to acknowledge complaints within 2 business days and resolve them within 5 business days. Details are set out in our Refund Policy.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or by displaying a notice in the Service. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
14. Governing Law
These Terms of Service are governed by the laws of Ukraine. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ukraine.
